1Acceptance and who can use this
By creating an account, completing an assessment, or using the service, you agree to these Terms and to our Privacy Policy and Telehealth Consent. You must be at least 18 years old, located in the United States in a state where we operate, and able to enter a binding agreement. If you do not agree, do not use the service.
2What Second Season is
Second Season Health LLC operates a technology and administrative platform that helps you connect with independent, licensed healthcare providers and, where a provider prescribes, independent licensed pharmacies that prepare and ship medication. Second Season is not a medical practice, does not practice medicine, and is not a pharmacy. Clinical decisions are made solely by your provider. Dispensing is done solely by the pharmacy.
3Not medical advice
The content on this website is general information and is not medical advice. Using the site does not create a provider-patient relationship with Second Season. A provider-patient relationship is formed only with the licensed provider who reviews your information, and only if that provider accepts you as a patient. Always talk with a qualified professional about your specific situation.
4Telehealth and provider discretion
Care is delivered through telehealth. In many states a provider may review your information through a secure online assessment. In some states a live consultation is required first. A licensed provider must review your information before anything is prescribed, and the provider has sole discretion to decide whether treatment is appropriate, to request more information, or to decline. Not everyone is a candidate, and being declined is a normal medical outcome, not a service error.
5Compounded medications
Some treatments a provider may prescribe are compounded medications prepared by a licensed pharmacy. Compounded medications are not FDA approved and are not reviewed by the FDA for safety, effectiveness, or quality. They are not generic versions of, or equivalent to, any brand-name drug. Your provider will discuss the risks and benefits with you before prescribing.
6Prescriptions and pharmacies
If a provider writes a prescription, it is filled and shipped by a licensed U.S. pharmacy in our network, currently EPIQ Scripts, Foothills Pharmacy, and Emerald Compounding Pharmacy. The pharmacy is responsible for preparing and dispensing your medication in line with the prescription and applicable law. Availability of specific medications may vary by state.
7Your account and responsibilities
- Give accurate, complete, and current information. Your provider relies on it, and incomplete or false information can lead to unsafe care.
- Keep your login secure and let us know promptly of any unauthorized use.
- Follow the plan your provider gives you and report side effects or concerns to your care team.
- Use the service only for yourself, not on behalf of another person.
8Pricing, payments, and cancellation
Prices are shown before you commit. By providing a payment method you authorize us and our payment processor to charge the amounts you approve. If you enroll in a subscription or automatic refill, you authorize recurring charges until you cancel, and you may cancel at any time before the next fill through your account or by contacting us. 9Acceptable use
Do not misuse the service. That includes providing false information, reselling or diverting medication, attempting to obtain a prescription you are not a candidate for, interfering with the site's security, or using the service for anyone other than yourself. We may suspend or close accounts that violate these Terms or that we believe present a safety or legal risk.
10Our content
The Second Season name, logo, site, and content are owned by Second Season Health LLC or its licensors and are protected by law. You may use the site for its intended purpose. You may not copy, resell, or create derivative works from our content without permission.
11Third-party services
The service relies on independent providers, pharmacies, and vendors. We are not responsible for the independent professional judgment of your provider or the dispensing decisions of your pharmacy, each of whom is separately licensed and responsible for their own services. Links to third-party sites are provided for convenience and are not endorsements.
12Disclaimers
The service and site are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error free, and we do not guarantee any particular health outcome. Nothing in these Terms limits any right you have that cannot be limited by law.
13Limitation of liability
To the fullest extent permitted by law, Second Season Health LLC and its owners, employees, and vendors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for the independent acts of your provider or pharmacy. This section does not apply to the professional liability of the licensed providers or pharmacies, who are responsible for their own care and dispensing. 14Indemnification
You agree to defend and hold harmless Second Season Health LLC from claims arising out of your misuse of the service, your violation of these Terms, or information you provided that was false or incomplete, to the extent permitted by law.
15Not for emergencies
The service is not for medical emergencies. If you are having an emergency, call 911 or go to the nearest emergency room. Do not use this website to request urgent or emergency care.
16Governing law and disputes
These Terms are governed by the laws of the State of [GOVERNING LAW STATE], without regard to conflict-of-law rules.
